  1. 1. General Conditions

Only these “Terms and Conditions” govern the reservations, services and products offered by the company “Smart Bnb SRL” as well as the payment terms.

Smart Bnb SRL reserves the right to modify these general terms and conditions of sale in accordance with changes in its commercial policy, economic and legal requirements. The new terms and conditions will take effect as soon as they are communicated to the customer.

The customer is deemed to be fully aware of these Terms and Conditions of Sale and to have accepted all the provisions thereof, except in the case of special agreements stipulated in writing.

  1. 2. Reservation

When booking a stay, this stay must be paid by the client in one of the following ways:

– by bank transfer;

– by debiting the customer’s credit card (credit card details need to be communicated to “Smart Bnb SRL”).

In the case where:

– The bank transfer is not paid by the date agreed upon at the time of the reservation, it will be cancelled automatically.

– The credit card details are not communicated by the date agreed upon at the time of the reservation, the reservation will be cancelled automatically.

  1. 3. Terms of Payment

– “Smart Bnb SRL” is allowed to charge between 25% and 75% deposit upon reservation. If discounts have been granted, “Smart Bnb SRL” reserves the right to claim full payment of the agreed price.

– When the deposit is not paid, “Smart Bnb SRL” is allowed to cancel the reservation without prior notice.

– All our invoices are denominated in euro and payable upon receipt.

– In case of delay in payment, the hotel shall be entitled to count, as of right and without formal notice, 15% interest on an annual basis until the day of full payment. In addition, the customer will automatically have to pay a flat rate of 15% of the amount of the invoice with a minimum of 50 euros from the first payment notice, sent by ordinary letter or email.

– Any delay in payment may give rise to a unilateral termination by “Smart Bnb SRL” of existing or future contracts, without any compensation.

– In case of a refund which should be made by “Smart Bnb SRL” to a customer, the customer is requested to communicate his banking details by email to “Smart Bnb SRL” so that the refund can be made (by bank transfer or credit card refund).

– Smart Bnb SRL rates are exclusive of drinks and TVAC (and all taxes included).

  1. 4. Cancellation & modification by the client

A reservation can be canceled or modified up to 7 days before the date of arrival (the day of notification of cancellation or modification and the day of arrival are included within 7 days). Cancellations must be notified in writing or by email to the company “Smart Bnb SRL”.

After these 7 days, the entire reservation will be due and invoiced.

Reservations for products and services with the company “Smart Bnb SRL” can be canceled or modified up to 5 days before the scheduled date.

Beyond this period, the reserved products and services will be fully invoiced.

In the case of death (notified via death certificate) or of illness (notified via medical certificate), these cancellation conditions remain applicable.

Any cancellation or modification must be made in writing. Any cancellation made in another form will be considered null and void and the stay will be invoiced.

Under certain conditions, the company “Smart Bnb SRL” reserves the right not to claim compensation.

  1. 5.

In case of no-show: the entire stay including the reserved products and additional services will be invoiced up to 100% of the total amount of the complete reservation.

  1. 6. No-show of the client

The customer must also behave according to the customs and the respect of the establishment and the other customers. Any serious or repeated violation gives the right to “Smart Bnb SRL” to end the stay with full payment of the reservation. The customer is responsible with regard to “Smart Bnb SRL” for any damage caused to persons, building, furniture, equipment and places accessible to the public.

  1. 7. Check-in and Check-out

Unless otherwise agreed in writing, the rooms are available at 4 p.m. the day of arrival. On the day of departure, these must be vacated by 11:00 a.m. If the scheduled time is exceeded, an allowance (“late departure”) of € 50.00 / room is charged.

  1. 8. No smoking & pets

The entire building is non-smoking. In the case of non-compliance with this rule, a fixed penalty of € 200 will be invoiced automatically.

Animals (dogs, cats, etc.) are not allowed in the establishment except with prior request and authorization from “Smart Bnb SRL”.

  1. 9. Force Majeure

In the event of force majeure, exceptional circumstances and / or incidents that are impossible to predict and beyond control, “Smart Bnb SRL” reserves the right to accommodate the client, without any form of compensation for the client, in another establishment, located in the vicinity and which will be of at least equal category. However, “Smart Bnb SRL” undertakes to inform the customer as soon as possible and by all means.

  1. 10. Applicable laws & jurisdictions

Relations between the buyer and the company “Smart Bnb SRL” are only subject to the Belgian law.

Any disagreement relating to jurisdiction, interpretation and / or execution of the agreements concluded, which cannot be settled amicably between the parties, will be submitted to the courts of Verviers.

  1. 11. Protection of privacy

All personal data is reserved for internal use by “Smart Bnb SRL”. Personal data is intended to be used for private viewing purposes only. Personal data communicated to “Smart Bnb SRL” is intended solely for the service of “Smart Bnb SRL”. They are in no case transmitted to third parties for advertising and promotion purposes. The customer has the right to object, access, rectify and delete this data at any time and free of charge. All you have to do is write an email to the managers of “Smart Bnb SRL”.
